Terms of Service

Welcome to History Traveled ("History Traveled," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the History Traveled website, mobile application, and related services (collectively, the "Service").
By accessing or using the Service, creating an account, submitting content, or purchasing a subscription, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement and consent of a parent or legal guardian.
By using the Service, you represent and warrant that:
- you are legally able to enter into a binding agreement;
- you meet the minimum age requirements above; and
- your use of the Service does not violate any applicable law or regulation.
2. The Service
History Traveled is a platform that allows users to explore, save, organize, display, and share location-based historical markers, travel experiences, event records, photographs, notes, and other related content.
The Service may include free and paid features, including subscriptions, account-based storage, map-based content, geolocation features, and community or public-facing contributions.
We may update, modify, suspend, or discontinue any part of the Service at any time, with or without notice, to the fullest extent permitted by law.
3. Accounts
To access certain features, you may be required to create an account. You agree to:
- provide accurate, current, and complete information;
- keep your login credentials secure and confidential;
- promptly update your account information if it changes; and
- accept responsibility for all activity that occurs under your account.
You may not share your account in a way that circumvents subscription limits or otherwise misuses the Service.
We reserve the right to suspend or terminate your account if we reasonably believe you have violated these Terms, created legal risk for us, harmed other users, or misused the Service.
4. User Content
4.1 What counts as User Content
"User Content" means any content you submit, upload, post, save, transmit, or otherwise make available through the Service, including but not limited to:
- historical markers;
- saved places and location pins;
- photos, videos, text, captions, reviews, comments, or notes;
- travel logs, event records, and lists;
- usernames, profile details, and account-generated collections.
4.2 Ownership during active account term
As between you and History Traveled, and subject to the rights granted in these Terms, you retain whatever ownership rights you may have in User Content you create and submit while your account remains active.
4.3 License you grant to History Traveled
By submitting or making User Content available through the Service, you grant History Traveled a worldwide, non-exclusive, transferable, sublicensable, royalty-free, perpetual during the active life of your account license to host, store, cache, reproduce, process, adapt, modify for formatting and technical purposes, display, perform, publish, distribute, index, promote, and otherwise use that User Content as necessary to operate and provide the Service.
4.4 Ownership transfer after account cancellation or deletion
If you cancel your paid subscription, delete your account, or otherwise terminate your relationship with the Service, then 30 days after the effective date of cancellation or account deletion, all right, title, and interest you may have in any markers, location records, collections, notes, photos, metadata, and other User Content previously submitted to the Service that remains on our systems shall automatically transfer and assign to History Traveled, to the fullest extent permitted by applicable law.
You acknowledge and agree that:
- this transfer is a material part of the bargain for your use of the Service;
- during the 30-day period, you are responsible for exporting or deleting any content you do not want retained, if such features are made available;
- after that 30-day period, History Traveled may retain, display, modify, repurpose, commercialize, curate, combine, or continue using such content without further notice, compensation, or approval; and
- you waive, to the fullest extent permitted by law, any claim inconsistent with that transfer.
If applicable law limits automatic assignment of certain rights, then you grant History Traveled an irrevocable, perpetual, worldwide, fully paid, transferable, sublicensable license to use, exploit, reproduce, modify, distribute, display, publish, create derivative works from, and otherwise commercialize that content for any lawful business purpose.
4.5 Your promises about User Content
You represent and warrant that you own the User Content you submit or have all necessary rights to submit it; that your User Content does not infringe any third-party rights; that your User Content is not unlawful, defamatory, fraudulent, or obscene; and that any factual information you submit is provided at your own risk.
4.6 No obligation to preserve content
We may, but are not obligated to, preserve, maintain, or continue hosting any User Content. We are not liable for deletion, loss, corruption, or failure to store any content.
5. Acceptable Use
You agree not to:
- violate any law or regulation;
- infringe intellectual property, privacy, publicity, or other rights;
- upload viruses, malware, or harmful code;
- attempt to gain unauthorized access to accounts, systems, or data;
- scrape, harvest, crawl, or extract data from the Service except as expressly allowed;
- interfere with or disrupt the integrity or performance of the Service;
- submit false, misleading, or fraudulent location information;
- use the Service to stalk, harass, dox, or endanger others;
- upload content that is hateful, threatening, sexually exploitative, or violent; or
- use bots or automated methods to create accounts or access the Service in a way that burdens our systems.
6. Location Data and Device Permissions
The Service may collect, process, and use precise or approximate location data, including GPS data, map interactions, saved places, marker coordinates, route information, timestamps, and related metadata.
By using location-enabled features, you consent to our collection, use, storage, and processing of location information as described in these Terms and our Privacy Policy.
You are responsible for your own safety and judgment when visiting any location shown in the Service. History Traveled does not guarantee the safety, accessibility, legality, accuracy, or current condition of any place, route, event, or marker.
7. Historical and Informational Content Disclaimer
Content within the Service is provided for general informational, educational, travel, or entertainment purposes only. We do not warrant that any historical or factual content is complete, accurate, unbiased, current, or error-free. Users should independently verify facts, dates, boundaries, locations, and access restrictions before relying on them.
8. Subscriptions, Billing, and Price Changes
8.1 Paid subscriptions
Some features may require a paid subscription. By purchasing a subscription, you agree to pay all applicable fees, taxes, and charges disclosed at the time of purchase. Subscriptions renew automatically unless canceled before the renewal date.
8.2 Billing platforms
If you purchase through Apple App Store, Google Play, or another third-party platform, your billing relationship may be governed in part by that platform's terms, and subscription management may need to be handled through that platform.
8.3 Cancellation
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period, and you retain access to paid features through that period. Canceling a subscription does not automatically delete your account.
8.4 Refunds
Except where required by law or the applicable app marketplace, all payments are non-refundable. We may, in our sole discretion, issue credits or refunds in limited circumstances but are not obligated to do so.
8.5 Price changes
We reserve the right to change subscription pricing at any time. If we increase pricing for a recurring subscription, we will provide advance notice before the new rate takes effect for your next billing cycle. For example, if a legacy subscription price changes from $4.99 to $9.99 per month, we will notify you before the change applies to your account.
9. Intellectual Property
The Service, including its software, design, branding, logos, text, graphics, interfaces, maps, compilations, databases, and other content excluding User Content, is owned by or licensed to History Traveled and is protected by intellectual property and other laws. Except for the limited right to use the Service in accordance with these Terms, no rights are granted to you.
10. Feedback
If you submit feedback, ideas, or suggestions regarding the Service, you grant History Traveled a worldwide, perpetual, irrevocable, transferable, sublicensable, royalty-free right to use and exploit them for any purpose without restriction or compensation.
11. Third-Party Services
The Service may integrate with third-party services including mapping providers, payment processors, analytics vendors, authentication providers, cloud hosting providers, app stores, and social sharing tools. We are not responsible for third-party services, and your use of them may be subject to separate terms and privacy policies.
12. Privacy
Your use of the Service is also subject to our Privacy Policy, which is incorporated into these Terms by reference.
13. Termination
You may stop using the Service at any time. We may suspend, restrict, or terminate your access if you violate these Terms, if we reasonably believe doing so is necessary to protect users or third parties, or if required by law.
Sections that by their nature should survive termination will survive, including those relating to ownership, transferred rights, licenses, payments, disclaimers, limitation of liability, indemnification, dispute resolution, and governing law.
14. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by law, History Traveled disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, or that the Service will be uninterrupted or error-free.
15. Limitation of Liability
To the maximum extent permitted by law, History Traveled and its officers, directors, owners, employees, contractors, affiliates, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, content, profits, revenue, goodwill, or business opportunity. Total liability for all claims shall not exceed the greater of the amount you paid to History Traveled in the twelve months before the event giving rise to the claim, or fifty U.S. dollars (US $50).
16. Indemnification
You agree to defend, indemnify, and hold harmless History Traveled and its officers, directors, owners, affiliates, employees, contractors, licensors, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Service, your User Content, your violation of these Terms, or your violation of any third-party right.
17. Dispute Resolution
17.1 Informal resolution first
Before filing a claim, you agree to first contact us and attempt to resolve the dispute informally by sending written notice to support@history-traveled.com with a description of the issue.
17.2 Governing law
These Terms are governed by the laws of the [Insert State], without regard to conflict of laws principles.
17.3 Venue
Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in [Insert County, State], and you consent to personal jurisdiction and venue there.
18. Changes to These Terms
We may revise these Terms from time to time. If we make material changes, we will provide notice by posting updated Terms and updating the effective date. Your continued use of the Service after the updated Terms become effective means you accept the revised Terms.
19. Miscellaneous
- These Terms constitute the entire agreement between you and History Traveled regarding the Service.
- If any provision is held invalid or unenforceable, the remaining provisions remain in full force.
- Our failure to enforce any provision is not a waiver.
- You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or asset sale.
